EPIC IMAGE PHOTO BOOTH RENTAL TERMS & CONDITIONS

The party that agrees to the terms and conditions listed below and provides their signature, vows to abide by the agreements contained herein and intend to be legally bound hereby, the Parties do agree as follows,

1. The Purchaser hereby engages Epic Image Photo Booth to provide a rental service. The remaining Balance is due 24 hrs before scheduled event. The service to be set up at event location listed on the Photo Booth Booking Form. The said Rental Service shall consist primarily of providing equipment for rental use.

2. All locations that require a second floor or higher setup, must have elevator access.

3. A 10′ X 10′ area is required for proper photo booth setup. If not enough space is provided, the photo booth will not be able to properly be setup.

4. A table will be provided by Epic Image for the props.

5. The Parties hereby agree that the rental service shall be provided and accepted on the dates and times listed on the Photo Booth Booking Form.

6. Any missing props will be charged the replacement cost value, to the purchaser.

7. The purchaser is responsible to pay a fee for any damage done to the photo booth. The fee will be assessed based on the cost to repair the damage done to the photo booth.

8. The Purchaser in consideration of the rental service to be rendered and the mutual promises contained herein, hereby agrees to pay Epic Image Photo Booth Rental the Booking Fee set on the Booking Form

9.   Epic Image Photo Booth Rental will arrive 60 minutes before the start time specified, to begin setup. For every hour in advance the purchaser would like the photo booth setup (but not operational), there will be a $125 fee.

10. The photo booth is a mechanical, technological piece of equipment. If for whatever reason the booth stops working due to a malfunction,  Epic Image Photo Booth Rental will not be held responsible.  Epic Image Photo Booth Rental will do its best to rectify the situation.

11. If the photo booth stops working due to improper use or abuse by the purchaser or purchaser’s guests, there will be no refund for remaining time of the rental.

12.  Epic Image Photo Booth Rental owns the copyrights to all of the photos and may use them at their discretion for promotional material.

13. Your rental ends at the specified time frame outlined in the photo booth booking form. At the time in which the rental ends, Epic Image Photo Booth Rental will begin the breakdown of the photo booth, even if the event has not yet commenced. If the purchaser would like the photo booth to remain up, until the end of the event, but not in use, a fee of $75 will be assessed per every additional hour in excess to the specified rental end time. If the purchaser would like the photo booth to remain up, until the end of the event and in use, a fee of $200 will be assessed per every additional hour in excess to the specified rental time.

14. Epic Image Photo Booth Rental hereby agrees to render their professional services before and after the event to set up and break down the equipment.

15. Photo Booth photos will be sent via a email and or text.

16. Photos will be held on file for 2 months after the event. After the 2 months, all photos will be deleted. Any requests for duplicates must be done within the 2 months.

Additional Terms and Conditions: The agreement of the rental service is subject to proven detention by accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions beyond their control. If such circumstances arise, all reasonable efforts will be made by  Epic Image Booth Rental to find a replacement rental at the agreed upon fees. Should Epic Image Photo Booth Rental be unable to procure a replacement, Purchaser shall receive a full refund of their reservation fee. Purchaser agrees that in all circumstances, Epic Image Photo Booth Rental liability shall be exclusively limited to an amount equal to the reservation fee and that Epic Image Photo Booth Rental shall not be liable for indirect or consequential damages arising from any breach of contract.

Cancellation Policy: If the rental is canceled 7 days before the specified rental date or less your deposit is non refundable. If the rental is canceled within 7 days or more from the specified rental date, the purchaser will be refunded the deposit unless discussed determined by Epic Image that the reason for cancellation is invalid. The purchaser and Epic Image Photo Booth Rental agrees that this contract is not subject to cancellation unless both parties have agreed to such cancellation. In the event the Purchaser breaches the contract, he or she shall pay Epic Image Photo Booth Rental the amount in which Epic Image Photo Booth Rental incurs in damages or expenses. It is understood that this is a “Rain or Shine” event, Epic Image Photo Booth Rental compensation is in no way affected by inclement weather. For outdoor events, Purchaser shall provide 10×10 area for setup area. Epic Image Photo Booth Rental requests that they be permitted at least 1 hour before the engagement and at least 1hour after the engagement for setup and takedown. If Purchaser or venue requires Epic Image Photo Booth Rental to complete setup more than one hour before the start time, or to postpone takedown more than 1 hour after the end time indicated, the additional time will be charged at the rate of $75.00 / hour. Purchaser shall provide Epic Image Photo Booth Rental with a 15-20-amp circuit outlet from a reliable power source (along the wall) of the set-up area. This circuit must be free of all other connected loads. Any delay in the performance or damage to Epic Image Photo Booth Rental equipment due to improper power is the responsibility of the purchaser. A 4 foot or longer banquet table is needed for the props to be setup which is to be provided by  Epic Image Photo Booth.  By executing this contract as Purchaser, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he or she is eighteen (18) years of age, and further, if executing said contract as agent or representative, that he or she has the authority to enter into this agreement and should he or she not have such authority, he or she personally accepts and assumes full responsibility and liability under the terms of this contract. All attached riders are an integral part of this contract. This contract will supersede any other contract. If any part of this contract is illegal or unenforceable, the remaining provisions of this contract will remain valid and enforceable to both parties. This contract contains the entire agreement between the parties and no statement, promises, or inducements made by any party hereto, or agent or representative or either party hereto, which are not contained in this written contract, shall be valid or binding. This contract shall not be enlarged, modified, or altered except in writing by both parties and endorsed hereon. The law of the State of VA shall govern this agreement. In the event of suit involving or relating to this agreement, the Purchaser agrees to defend, indemnify, assume liability for and hold  Epic Image Photo Booth Rental harmless from any claims, damages, losses and expenses by or to any person, regardless of the basis, which pertains directly or indirectly to Epic Image Photo Booth Rental performance. Purchaser may not transfer this contract to another party without the prior written consent of Epic Image Photo Booth Rental. This agreement is not binding until signed by both Purchaser and an employed representative of Epic Image Photo Booth Rental. Any changes must be written and signed by both the Purchaser and by Epic Image Photo Booth Rental Oral agreements are non-binding. If any clause in this agreement is found to be illegal, the rest of the agreement shall remain in force. The parties hereto promise to abide by the terms of this agreement and intend to be legally bound thereby. 

A copy of this policy can be emailed to each client at your request. Paying Deposit for service is signature for acknowledgment and agreements for service.
